Terms of Service

1. Agreement to terms
By accessing or using FoPost's website (fopost.com), Cloud dashboard (app.fopost.com), SDK packages, MCP server, API, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you and FoPost("we," "our," or "us"). We may update these Terms at any time by posting the revised version on this page.
2. Service description
FoPost is an AI-powered social media management platform that enables you to:
- Schedule and publish content across 30 supported platforms
- Generate per-platform variants of your posts using AI
- Manage multiple workspaces, brands, and accounts from one interface
- Integrate with your applications via REST API, SDKs, and an MCP server
- Automate publishing from RSS feeds, blogs, and webhook triggers, with human-in-the-loop approval
The Service is available as a managed Cloud product and as open-source SDK packages. The PHP SDK (owlstack/owlstack-core) is MIT-licensed on Packagist. The TypeScript SDK ships via npm. The FoPost MCP server ships via npm (@owlstackapp/mcp) for Claude Desktop, Cursor, ChatGPT, and any MCP-compatible client.
3. Platform terms compliance
By using FoPost to publish to third-party platforms, you agree to comply with the terms of service, developer policies, and community guidelines of each platform you connect. Supported platforms include X (Twitter), Facebook, Instagram, LinkedIn, TikTok, YouTube, Threads, Bluesky, Pinterest, Reddit, Discord, Mastodon, Telegram, Slack, DEV.to, Hashnode, Medium, Tumblr, WordPress, Google Business Profile, Dribbble, Twitch, Nostr, Lemmy, MeWe, Whop, and Listmonk.
FoPost is not responsible for actions taken by these platforms against your accounts due to content you publish or violations of their policies. You are solely responsible for ensuring your content complies with each platform's rules.
4. Eligibility
You must be at least 18 years of age to use the Service. By using FoPost, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
5. Accounts
To access certain features, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Keeping API keys secret. Per-workspace scoped API keys can be rotated at any time from workspace settings
- Notifying us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.
6. Subscriptions and payments
FoPost offers paid subscription plans, each starting with a free trial period. An active subscription is required to publish. For paid plans:
- Billing: Subscriptions are billed on a recurring basis (monthly or annually) and automatically renew unless cancelled.
- Pricing: All prices are listed on our pricing page and are subject to change with 30 days' notice.
- Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period.
- Refunds: Except where required by applicable law, all fees are non-refundable, including for partially used periods. Cancelling stops future renewals and does not entitle you to a pro-rata refund of the current period. We begin providing the service immediately, and the trial period is there so you can evaluate FoPost before any charge is made.
- AI credits: AI features use a per-feature credit system. Credit balances reset on each billing period. Unused credits do not roll over. These features draw on third-party processing that we purchase and that is consumed on your behalf as you use them. By using them you request that we begin providing them immediately, and credits that have been consumed cannot be refunded.
Open-source SDK
The FoPost PHP SDK (owlstack/owlstack-core) is released under the MIT License and free to use without a subscription. The TypeScript SDK ships under a permissive license and is free to use with any FoPost account. Cloud features (AI rewriting, managed publishing, analytics) require an active subscription and may consume AI credits.
7. User content
You retain full ownership of all content you create, upload, or publish through the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit your User Content solely for the purpose of operating the Service on your behalf.
You represent and warrant that:
- You own or have the necessary rights to your User Content
- Your content does not infringe any third-party intellectual property rights
- Your content complies with all applicable laws and platform guidelines
8. AI content and features
FoPost provides AI-powered features including per-platform content rewriting, Brand Voice profiles, the FoPost Agent chat planner, and inbox reply suggestions. Regarding AI-generated or AI-modified content:
- You retain full commercial usage rights to any AI-generated or AI-assisted content
- AI suggestions are provided as-is and should be reviewed before publishing
- We do not use your content to train our AI models without your explicit opt-in
- We do not guarantee the accuracy, appropriateness, or platform compliance of AI-generated content
- You are responsible for reviewing and approving content before it is published. Approval mode is on by default for automations
9. Connected accounts and derived signal
When you connect a social account, FoPost reads what that account can already see on the platform, using your own authorisation and the platform's official endpoints. That includes the replies, comments and mentions that reach your accounts, the performance of what you publish, and, where you name accounts to track, what those accounts publish publicly. We call this your connected view.
You grant us the right to process your connected view to operate the Service for you, and to derive aggregate and derived signal from it: counts, scores, benchmarks and trend statistics that describe patterns rather than any individual item. We use that signal to run and improve the Service, including the analytics, timing and benchmarking features you see in your own workspace.
Two commitments bound that right, and they are enforced in the product, not just stated here:
- Contents never leave your workspace. The text of posts, comments, messages or replies, the identity of the people in your connected view, your follower lists, and anything from which those could be reconstructed are never disclosed to another customer, in any form. There is no anonymised version of those contents that we treat as shareable
- Only wide aggregates can ever be shared. A statistic derived from your connected view is only ever published outside your workspace once it covers enough distinct sources and enough distinct customers that no single item or account can be recovered from it. A number describing one customer stays with that customer
You are responsible for connecting only accounts you are authorised to connect, and for tracking only what the relevant platform's terms permit. We do not scrape: every read runs through the platform's official interfaces under your authorisation, and platform coverage is limited to what those interfaces allow.
Disconnecting an account, deleting a workspace, or closing your account removes the connected-view records it produced. Aggregate statistics that already cover enough distinct sources and customers to be non-identifying may be retained, because they no longer describe you. Our Privacy Policy and Data Processing Agreement set this out in full.
10. Prohibited activities
When using FoPost, you agree not to:
- Use the Service for spam, unsolicited messaging, or bulk automated posting that violates platform rules
- Attempt to circumvent rate limits, usage quotas, or security measures
- Share, sell, or redistribute your account credentials or API keys
- Use the Service to publish illegal, defamatory, or harmful content
- Reverse engineer, decompile, or disassemble the Cloud service (the open-source SDKs are exempt under their respective licenses)
- Impersonate others or misrepresent your identity
- Interfere with or disrupt the Service or its infrastructure
11. Intellectual property
The FoPost brand, logo, Cloud dashboard, and proprietary features are owned byFoPost and protected by intellectual property laws. The FoPost PHP SDK source code is released under the MIT License, and you are free to use, modify, and distribute it in accordance with that license.
Nothing in these Terms grants you rights to use our trademarks, logos, or branding without prior written consent.
12. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, including for violations of these Terms. Upon termination:
- Your right to use the Cloud service ceases immediately
- We may delete your account data after 30 days
- OAuth tokens to your connected platforms are revoked
- Content already published on third-party platforms is not affected
- Your right to use the open-source SDK under the MIT License is not affected
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOPOST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
15. Indemnification
You agree to indemnify and hold FoPost harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms or any third-party rights.
16. Governing law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
